These Terms & Conditions govern the provision of therapy, assessment, workshop, and supervision services by EK Psychotherapies Ltd ("we", "us", "our") to you ("client", "you"). By booking or using our services, you agree to these terms.

1. About Us

EK Psychotherapies Ltd is a mental health practice offering evidence-based therapies (including CBT and EMDR), neurodiversity assessments, workshops, and clinical supervision. All sessions are delivered online.

2. Who These Terms Apply To

These terms apply to:

- Individual clients booking therapy, assessment, or related services directly with us.

- Organisational clients — businesses, schools, or other institutions — who refer individuals to us or contract with us for workshops, training, or an employee/student support arrangement (e.g. EAP-style referrals).

Where we work with an organisation, a separate agreement may set out specific commercial terms (fees, volume, reporting); where it does, that agreement takes precedence over this section in the event of a conflict, but these terms otherwise continue to apply to the individual sessions themselves.

3. Assessments and Suitability for Therapy

Every new client begins with an initial assessment. This helps us confirm that therapy is safe, appropriate, and suited to your needs and goals. We reserve the right to decline to offer therapy, or to refer you elsewhere, if we assess that we're not the right fit or that your needs would be better met by another service (for example, if a higher level of care is required than we can safely provide online).

4. Booking and Sessions

- All sessions are conducted online via Zoom/Teams, Goggle Meet, and it is your responsibility to have a stable internet connection and a private, confidential space for sessions. Each clinician is responsible for selecting and managing their own video platform for delivering sessions, and for sending session invites and links to clients securely. Clinicians will take reasonable steps to ensure the confidentiality of session links and any information shared as part of the booking process.

- Session length, frequency, and fees will be confirmed at the time of booking or in your initial assessment.

- We aim to provide continuity of care but cannot guarantee identical appointment times will always be available; where changes are necessary, we'll give as much notice as possible.

5. Fees and Payment

- Fees are as agreed at the time of booking and may be paid per session, in advance for a block of sessions, or by invoice, depending on the arrangement confirmed with you.

- Payment can be made by card/online payment (via Stripe) or by BACS bank transfer, depending on your booking.

- Fees are due 72 hours prior to your scheduled booking, which will be recorded on your invoice. We reserve the right to pause future sessions if payment is significantly overdue.

- We will give reasonable notice of any change to our fees; changes will not apply retroactively to sessions already booked and paid for.

6. Cancellations and Non-Attendance

- We require at least 24 hours' notice to cancel or rearrange a session.

- Cancellations made with less than 24 hours' notice, and non-attendance ("no-shows"), will be charged at the full session fee.

- We understand emergencies happen; if there are genuinely exceptional circumstances, please contact us and we'll consider these on a case-by-case basis, entirely at our discretion.

- If we need to cancel or rearrange a session (for example, due to illness), we will give you as much notice as possible and no fee will be charged for that session.

7. Confidentiality

- Everything discussed in sessions is treated as confidential, in line with our professional and ethical obligations, and is set out in more detail in our Privacy Policy.

- Confidentiality has limits. We may need to break confidentiality, without your consent if necessary, where:

  - We believe there is a risk of serious harm to you or to another person.

  - We are required to do so by law (for example, in response to a court order, or under safeguarding legislation involving a child or vulnerable adult).

  - Disclosure is necessary to prevent a serious crime.

- Where possible and appropriate, we will discuss any decision to break confidentiality with you first.

- We may discuss anonymised aspects of our work in clinical supervision, which is a standard and required part of ethical practice; your identifying details are not shared in this context.

8. Safeguarding and Risk

Your safety is our priority. If, during the course of our work together, you disclose a risk of serious harm to yourself or others (including risk to a child or vulnerable adult), we may need to take action outside of the therapy session itself. This could include:

- Contacting emergency services (999) or urgent mental health crisis services on your behalf, where we believe there is an immediate risk to life.

- Sharing relevant information with your GP or another appropriate professional.

- Contacting a nominated emergency contact, where one has been provided and it is appropriate to do so.

This may occur without your prior consent where we judge it necessary to protect your safety or the safety of others, in line with our professional and legal obligations. Please note that therapy delivered online is not a substitute for emergency services, and in a mental health crisis you should always contact 999, 111, or your local crisis team directly.

9. Client Responsibilities

To help sessions run safely and effectively, you agree to:

- Attend sessions in a private space, free from interruption, where confidentiality can reasonably be maintained.

- Provide accurate information relevant to your care, including relevant medical or mental health history.

- Let us know promptly of any change in circumstances that may affect your treatment or safety.

- Treat practitioners and staff with respect; we reserve the right to end the therapeutic relationship, with appropriate signposting to alternative support, if this expectation is not met.

11. Limitation of Liability

- We provide services with reasonable skill and care, in line with recognised professional standards, but we do not guarantee specific therapeutic outcomes — the results of therapy depend on many factors, including your own engagement with the process.

- We are not liable for issues arising from technical failures outside our reasonable control (e.g. internet outages, third-party platform downtime), though we will make reasonable efforts to reschedule any session materially disrupted in this way.

- Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else which cannot lawfully be limited or excluded.

12. Data Protection

Our collection and use of your personal data, including clinical records, is set out in our Privacy Policy, available at ekpsychotherapies.com/privacy-policy. By using our services, you also agree to that policy.

13. Changes to These Terms

We may update these Terms & Conditions from time to time, for example to reflect changes in our practices or legal requirements. Continued use of our services after an update constitutes acceptance of the revised terms. The effective date at the top of this page shows when it was last updated.

14. Governing Law

These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
